Link3 Selfcare Application (referred to as the “Link3 Selfcare App” "App"), developed and provided by Link3 Technologies Limited, serves as a customer service application. This Privacy Policy is part of Terms of Service of Link3 Selfcare App and covers the treatment of user information, including personally identifying information, obtained by Selfcare App.

Link3 Technologies Limited, ("we," “Link3”, "our," or "us") is committed to protecting your privacy. This Privacy Policy (this “Privacy Policy” or this “Policy”) governs how we collects, uses, maintains and discloses information collected from users (a “User”, as well as “you”, “your” and similar terms) and safeguard your personal information when you use the Link3 Selfcare App. By using the App, you consent to the practices described in this Privacy Policy.

This Privacy statement explains how Link3 Selfcare App utilizes and safeguards any information you provide us with when using our services. We have established privacy rules that define and enforce the structure and accountability for secure and respectful collection, use, and sharing of your personal information because we understand how important it is to protect and safeguard the data you have entrusted to us.

All of our operations are guided by the T.R.U.S.T. principles, which stand for Transparency, Respect for Your Rights, Use of Your Personal Data, Implementation of Robust Cyber Security Practices, and Due Care when Data Transfer is required.

Technical information, including the device version, a unique device identifier, mobile network information, and your mobile operating system.

We may collect information from such as your name, billing addresses, email address, phone number, date of birth, user ID and password, payment information, NID details and other relevant contact information.

We may collect information about how you use the App, including your interactions with the features and functionalities provided.

We obtain the user's consent for notification, storage, and gallery access on their mobile device.

To contact you, Link3 Selfcare App might utilize your personal information. Updates, bugs, alarms, and other issues pertaining to the technical features and usability of the application and other services may be discussed in the communication. Such interaction is regarded as a component of the service.

In order to enhance the quality and effectiveness of the services, we may occasionally ask you for information regarding your experience using the application or other components of the services. You are not required to give this information. Such data will be analyzed to examine how we might improve our services.

Link3 Selfcare team may occasionally get in touch with you by phone, notification, or any other suitable information channel to update you on the latest developments regarding Selfcare and its services, such as new goods, campaigns, promotions, and payment options.

FORCE MAJEURE

Link3 is held not liable for any default or delay in the performance of any of its obligations under this Policy  if such default or delay is caused, directly or indirectly, by forces beyond such Our  reasonable control, including, without limitation, Act of God, Act of Nature, insurrection or civil disorder or commotion, war, act of terrorism, strike or military operations, national or local emergency, acts or omissions of Government or other competent Authority, imposition of Government, sanction, embargo or similar action, Government requirement, civil or military Authority, act or omission of carriers or suppliers (other than the parties themselves) natural disaster including fire, lightning, flood, earthquake inclement weather, power failure, explosion, industrial action, criminal damage or destruction to equipment or disruption to any Network service caused by any software virus, worms, denial of service attack, the inability of any equipment to operate optimally due to any unauthorized action such as spamming, sabotage acts, hacking attacks (provided that the Parties have taken reasonable step to prevent such hacking attacks) or omissions of person or bodies for whom the Party has no control or any other cause whether similar or dissimilar outside the Party’s control. 

RETENTION OF DATA AND INFORMATION SECURITY

In order to prevent unauthorized access to, use of, or disclosure of the customer information we collect or store, Link3 has put in place technical, administrative, and physical protections. Employees receive training on the value of maintaining privacy and the right handling of customer information in terms of access, use, and disclosure. Access to sensitive personally identifiable information is only permitted for those who have a business need for it, in accordance with our practices and standards. Only as long as is practically necessary for business, accounting, tax, or legal purposes are personally identifiable information and other sensitive records kept.

UPDATING AND GAINING ACCESS TO YOUR INFORMATION:

You can update your information online or by calling a customer service agent if there are any errors in it.

DATA SHARING AND DISCLOSURE:

We will take reasonable measure to protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction but we do share your personal information with third parties we trust in order to provide you with our services, as follows:

a)    We may share the information we collect about you with the Link3 corporate family, including our affiliates and subsidiaries;

 

b)    We may disclose your information to service providers and other third-parties under contract who help with providing you and others our Services on our behalf or other services provided by third-parties via our Services (such as, but not limited to, fraud and spam investigations, payment processing, site analytics and operations, providing special partnership features in our service– either on an aggregate non identifiable basis, or using a unique identifier which is not attributable to you). They are required to secure the data they receive and to use the data for pre-agreed purposes only.

 

c)     We may disclose your information to law enforcement, governmental agencies, or authorized third-parties, in response to a verified request relating to terror acts, criminal investigations or alleged illegal activity or any other activity that may expose us, you, or any other App user to legal liability.

 

d)    We may disclose your information to protect our rights, privacy, safety, or property and in connection with a business transaction, such as a merger or acquisition.

SECURITY & DATA PROTECTION:

We have implemented the good practices to ensure security and data protection of our users' Personal Data. When users submit Personal Data in the app, we strive to ensure that Personal Data is protected both online and off-line. However, please be aware that no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure and we cannot guarantee the absolute security of your data.

If you create a User Account by selecting a password and providing your name, you are responsible for all activities that occur under your User Account. You agree to notify Link3 immediately of any unauthorized use of your User Account or any breach of security with respect to your User Account including your password. Link3 will not be liable for any loss that you may incur as a result of someone else using your User Account, either with or without your knowledge. In addition, you may be held liable for any losses incurred by us or another party due to someone else using your User Account. Link3 shall be entitled to monitor your User Account and password and, at its discretion, require you to change your password. If you use a username and password that Link3 considers insecure, Link3 will be entitled to require this to be changed and/or terminate your User Account.

VIOLATION OF SECURITY SYSTEMS:

You are prohibited from using any services or facilities provided in connection with this Service to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g. password guessing programs, cracking tools, malware, or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Link3 reserves the right to release your details to system administrators at other sites, law enforcement and/or governmental authorities in order to assist them in resolving security incidents. You may not reproduce, sell, resell, or otherwise exploit any resource, or access to any resource, contained on this Service.

LAW AND PROTECTION:

We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users, Selfcare App, or others. 

TERMINATION AND SUSPENSION:

You agree that We may suspend/terminate the services without notice and without any liability if:

(i) We reasonably believe that the services are being used in violation of

a.     the terms and condition of this Privacy Policy

b.    Any law whether of local, national and international;

(ii) You fail to cooperate with any reasonable investigation of any suspected violation of laws or terms and condition of this policy;

(ii) WE reasonably believes that the suspension of service is necessary to protect its network or its other customers, or

(iv) As requested by a law enforcement or regulatory agency.

YOUR RESPONSIBILITY: 

If you want to use our service, you have to install Selfcare App on your device with a valid contact number. You are responsible for all activities that occur under your User Account. You agree to notify Link3 of any unauthorized use of your User Account. We will not be liable for any loss that you may incur as a result of someone else using your User Account, either with or without your knowledge. Apart from the above, you may be held liable for any losses incurred by us or another party due to someone else using your User Account.

Indemnity

You agree to defend, indemnify and hold harmless Link3, its affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Link3 Selfcare App Service; (ii) your violation of any term of these Privacy Policy including any of the foregoing provisions, representations or warranties, from your placement or transmission of any content onto Link3 Selfcare App servers and/or from any and all use of your User Account; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Status Submissions caused damage to a third party (v) any acts or omissions by you. The terms of this section shall survive any termination of this Agreement.

LIMITATION OF LIABILITY:

In no event shall Link3, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our service, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our servers, (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our service by any third party, (v) inability to use the service, (vi) the disclosure of information pursuant to these privacy policy or Terms of Service and/or  (vii) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Link3 Selfcare users, whether based on warranty, contract, tort, or any other legal theory, and whether or not the Link3  is advised of the possibility of such damages. Without limitation, you (and not any member of the Link3 Selfcare App) assume the entire cost of all necessary servicing, repair, or correction in the event of any such loss or damage.

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that Link3 Selfcare App shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

RESERVATION OF RIGHTS:

Link3 reserves the right to modify or discontinue, temporarily or permanently, all or any part of this Service and/or any software/licenses, facilities, and services on this Service, with or without notice and/or to establish general guidelines and limitations on their use.

LOCAL REGULATIONS:

We make no representation that our Service is available for use or permitted by law in any particular location. To the extent you choose to access our Service, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. You are responsible for complying with local laws, if and to the extent local laws are applicable. You specifically agree to comply with all applicable laws concerning the transmission of technical data exported from the country you reside in.

 

ASSIGNMENT, CHANGE OF CONTROL, AND TRANSFER:

All of our rights and obligations under our Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner.

GOVERNING LAW AND JURISDICTION:

This Privacy Policy shall be deemed to be made and entered into pursuant to the laws of Bangladesh and for all purposes this Privacy Policy shall be construed and interpreted in accordance with and be governed by the law of Bangladesh.  

CHANGES TO THIS PRIVACY POLICY:

We may, in our sole discretion, revise this Privacy Policy at any time and from time to time. Your continued use of the Services following the posting of revisions to this Privacy Policy will be deemed your acceptance of such revisions.  We encourage Users frequently to check the email account that they use in connection with the Services, as well as this Privacy Policy, to stay informed about any changes to this Privacy Policy. Users can always consult our privacy policy to learn what personal data we collect, how and why it is processed, and under what circumstances such information may be shared, both on our website (under Legal Information) and on our app (under Customer Service).  You acknowledge and agree that it is your responsibility to review that email account and this Privacy Policy periodically.  The date at the bottom of this Privacy Policy will be updated for each revision.

a.     If any provision or a portion of any provision of this Privacy Policy is found to be illegal, invalid or unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions, the remaining provisions or portions (unless otherwise specified) thereof shall remain in full force and effect. 

b.    This Privacy Policy, together with the Terms of Service and any other policies and legal notices published by Link3 Selfcare shall constitute the entire agreement between you and us concerning the Link3 Selccare Service.

c.     In the event you read these terms in any language other than English, you agree that in the event of any discrepancies, the English version shall prevail.

d.    No waiver of any term of this Privacy Policy shall be deemed a further or continuing waiver of such term or any other term, and Link3 failure to assert any right or provision under these Privacy Policy shall not constitute a waiver of such right or provision.

e.     This Privacy Policy shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and permitted assigns.

f.     Link3 and User are independent contractors and nothing contained in this policy places Link3 and User in the relationship of principal and agent, partners or joint ventures. Neither party has, expressly or by implication, or may represent itself as having, any authority to make contracts or enter into any agreements in the name of the other party, or to obligate or bind the other party in any manner whatsoever.
